Default OK, my neighbours blew it!

Yesterday I heard a lot of excited chattering at full volume near to my back
door over the fence. My neighbours are incapable of speaking in normal
tones for some reason.
I eventually went out to find they were "pruning" two of my trees by
gettting on a ladder and leaning over my fence. Yes, they are entitled to
remove branches if they are over their side, but these were twigs and
they've hacked and massacred my tree which was just coming into fruit by
taking out half of the three trunks, which they are not allowed to do.
Reducing the height is not allowed.
I said "what do you think you are doing? stop it at once."
Needless to say, they didn't. So I said "if you continue you might regret
this.." They continued.
They have really damaged my tree and I use the fruit to make wine. Plus
they threw the remains over their back wall into the plot one of my
neighbour owns.

Next stop my solicitor to get the end of their wall out of my garden. I was
hoping to avoid this but I am so livid now that I am prepared to spend money
I was hoping would keep me going until the middle of next year.
It will take me a few days to write out the history and drawings to present
to my solicitor but they've gone too far this time.
I've never had such bad neighbours ever. All that blackmail about not
allowing my car out etc, forcing me to get a block kerb in and now this.
I wanted to push him off his ladder when he was ruining my tree but decided
against it. It would not help my case, would it?

No it wouldn't, but I can hardly blame you for thinking about it. These
people are the @$$h*les of the century! I've had annoying neighbors, such
as the guy on the floor above me who turned his stereo on really loud at
11PM, and then went to his graveyard shift job, leaving the music pounding
over my head for hours. Once I talked to the guy, he was OK about it, so
I'd say he was more clueless than antagonistic. But I've never had
neighbors go out of their way to damage things that belonged to me. I'm
sorry you have such losers as neighbors.

You sure have the worst neighbors... How can any one be so thoughtless
and mean.. I sure hope they get what they deserve... Good luck... Keep

This is legally classed as trespass on your property and they should
also have offered you the branches back. You should complain to the
council but if you're contacting your solicitor, I'd tell him as well.
Take photos of the damage and the position, and the branches in your
neighbour's plot, and write down the date, time and all details.
I am sorry that your previously lovely neighbours have been replaced by
such morons, I feel infuriated on your behalf!

Question: might you be entitled to legal aid? I hate the thought of you
using up your precious savings challenging these idiots.

In the U.S., you could charge for trespass, and you could also receive
damages for the loss of the tree. If it is damaged sufficiently so that it
needs to be removed, you could also charge for the removal and its
replacement with a *mature* tree (a costly proposition for the neighbors,
which they well deserve). I don't know if your laws are the same, but I
suspect they are because so many of our laws are based on English law. Your
solicitor would answer that question. It often would not be worth going to
court for this type of trespass and property damage, but you are not talking
about actual monetary value here--it is the constant harassment that is the
basis of your ire (and this might even fit the criteria for a harassment
suit). Incidentally, a great many U.S. laws are based on Blackstone's
"Commentaries on the Laws of England."

civil relations whatsover.

Legal Aid is not as good as you might think. I was awarded it once and as
I won my case I had to pay it all back! You only get away with nothing to
pay if you lose.

In any case, what I have is a civil case, it would not be funded by Legal
Aid so I will have to do it myself.
As much as I don't want my savings used up, my neighbours have have gone
beyond what I can tolerate.
I am looking online for a local solicitor that specialises in boundary
disputes - because this is what it is.
I am totally fed up with the whole thing.
The worst thing they ever did was send their daughter to my house saying
"you allow us to build our 6 ft 6 inch wall three feet away from your
kitchen window we will let you get your car out of your drive"
That was a really silly thing to say.

I intend to consult a solicitor this week with the view to getting the end
of their wall removed from my garden. I would have left it alone had they
not massacred my tree.
A few small branches and twigs were "in their airspace" and they did far too
much than they were entitled to do.
Actually, what they've done will cause it to grow even more next year - even
more over their side as they didn't have a clue, just got a saw and did it.
I have truly never had neighours like this and I would not wish them on
anyone.
Once upon a time this road was a quiet place.

I see your camera isn't working so I strongly suggest you borrow one.
Pictures are excellent evidence in court cases. It would be hard for a
judge to picture (pun not intended) the damage and boundaries without
photos.

Throw-away cameras are available and very inexpensive. A lot of people
keep one in their cars to document fender bender damages.

Probably not, although I know nothing about UK law. When my niece
ripped me off for all that money I had in CD's, the reason I didn't take
it to Civil Court was that I figured I'd be throwing good money after
bad. I couldn't have her arrested, because her name WAS on them as
joint owner, and I couldn't prove it was fraudulently, because her
mother, who had been managing them for me, was dead and could not
testify to my initial ownership. Because they were with a bank in
Wisconsin, I would have had to hire an attorney there, and travel back
there when the case came to court (maybe more than once, if it were
continued). The district attorney there thought I'd stand a good chance
of winning a civil case, but I really couldn't afford to take the chance
of wiping out the rest of my meager life-savings.

Unfortunately, people can't always be ARRESTED for breaking the law,
when "only" property is involved!
