(OT) The Lawyer Won't take my case

I'm very upset. They won't take my case against the HOA, not even to make a
simple phone call. Looks like I'm going to have to present the case before
the board myself.

John keeps telling me I can do this. Present a strong case and win them
over. I'm not as confident in myself as he is.

Meanwhile I have to figure out where to get this money. Because I don't
want to have to move again. Where would I go? There's no place I can
actually call "home". Being a military brat has left me with nothing.
Dammit! I thought I'd never have to move again.

This is driving me crazy. I can't sleep. I can't eat. I'm very upset.

Because life is nothing like a tv show, and lawyers don't really want to take cases from poor people, unless they can be assured of some large payback.. Just not going to happen.
I learned that when my friend got hit by a car while she was walking across the street, and because she's poor, the other guy got off scott-free. The ONLY thing the lawyer did right was keep the other guy's insurance company from trying to bill my friend 'for damaging his car'. Grrr..

I have very little respect for lawyers now.

take cases from poor people, unless they can be assured of some large
payback. Just not going to happen.

Not all lawyers are scumbags, but a great many of them are. I worked for a
lawyer for four years. During that time, I came into contact with quite a
few lawyers. There were only two of them I would really trust. One was the
man I worked for. He's in his 80s and still practicing. A friend of mine
recently passed the bar, and I trust her. Otherwise, I'd have nobody to go
to once the man I worked for retires.

Lawyers are greedy, just like everyone else. I met with a junior associate.
His boss is the lead counsel and he said if I'm not willing to take the
associaition through a court battle (at the cost of potentially thousands of
dollars) then he isn't interested. I can't afford that. I have a case, I
just can't afford to have them drag this thing out until I die.

So... I may put the house on the market anyway. And if so, I'll seriously
underprice it. Anyone want to buy a house for $70,000? LOL That will drive
all the property way down. There are tons of houses for sale here. I
really don't think they want the property values to go down like that.
Maybe they'll be willing to negotiate a deal over this stupid club
membership.

Well, the lawyer certainly isn't an altruist, is he? But wow, the insurance
company is the real scumbag here. "Damaging his car"??

I'm sorry you're upset, Jill. I think John is right -- present your
own case.
My daughter did; and won; however, it wasn't an issue nearly of the
magnitude you have. She only have to convince them that having four
cats inside the house was not going to impact the "neighborhood" in
any way, shape or form.
What's the going rate for attorney fees now? The last time we used an
attorney for anything IIRC it was $150 an hour. If the case turned out
to
be a lenghty process, you could very well spend more on attorney fees
than several years' worth of HOA fee nonsense.
But still, there's a principle here, and what they're doing is just
plain wrong.

Back in 1993 Dave and me got unfairly dismissed big time about the
time my dad died so his solicitor was prepared to hear me out free of
charge (he was making a bomb from sorting out what was a very basic
"shared" will i.e. if dad died beofre mum she got everything and vice
versa) he agreed I had a case a very strong one but told me I;d need
to retain a barrister and could I get £200-£500 together for a start

I think one of my favourite memories of my mum is the morning after
she died we went back to her place and my middle brother who was
closest to her opened the file where she kept all all paperwork and on
top was an envelope addressed to him which contained a little card
inside of which she'd instructed that after all the money was sorted
out she wanted this sum and that sum to go to various grandchildren/
step grandchildren and he collapsed saying "She knew she was dying"

Later on my youngest brother told me she'd written that card 2 or so
years before after discussing it with him. She said she couldn't
discuss it with my middle brother simply because he wouldn't have it
and kept saying "You'll out live us all!"
but since as she so charmingly put it to my youngest brother "You're
the coldest least emotional bast**d I know" Did he think if she wrote
it out my other brother would carry out her instructions? My brother
replied "Of course he would but to be sure you could always add a
codicil to your will"

And she calmly replied "That bast**d (insert name of family solicitor)
woud charge me a fortune just to do something as simple as that!And I
wouldnt give the him a penny more than I have to"

Sounds as though you chose an honest lawyer, at least! The problem with
HOA's is that THEY hold all the cards - more and more, since they've
become common in "normal" housing developments, as well as condominiums.
I'm sure your parents had no intention of embroiling their heirs in
the situation you find yourself in, but people don't always read all the
fine print in contracts. (And if something SOUNDS outrageous, they
assume it couldn't possibly mean what it says - how many people found
themselves stuck with mortgage payments escalating to amounts they
couldn't afford, because they didn't understand what "APR" meant, and
their realtors didn't explain?) Sometimes one just has to weigh the
likelihood of winning against the cost of fighting, and choose the
lesser of two evils.

When that niece of mine stole $55,000 of CD's from me, the district
attorney in the small Wisconsin town where that bank was located thought
I would probably have won a judgment against her in a civil suit, since
I had good evidence that it WAS my money. (I was the primary
account-holder and had been paying tax on the income for years.)
Unfortunately, she had managed to get her name on the documents as
"joint owner" (she had childhood friends who worked in that bank - but I
had no way of proving they helped her), so I couldn't just have her
arrested. A civil suit would have meant hiring an attorney back there,
appearing in court for any scheduled trial dates (which would have
involved travel from California, and hotel bills for my stay there),
with no guarantee that I'd get my money without a garnishee on her wages
(and she could have simply quit her job, meaning MORE legal fees). Even
if I'd won the lawsuits, it seemed like sending good money after bad, so
I'm just out the money (and none of her kids or her brother and sister
are speaking to me, anymore).

If I sometimes sound a bit prejudiced against "born again" Christians,
she's the reason, since she claims to be one - I'm just hoping her
beliefs are correct, because if so, I think she'll have a nasty surprise
waiting when she reaches those "pearly gates"!
